This matrix tracks the frequency and subjects tested on the written (essay) portions of the bar exam across the United States. For states using the Uniform Bar Exam (UBE), the subjects are standardized via the Multistate Essay Examination (MEE).
1. The UBE/MEE Subject Matrix
The following subjects are tested in the 41+ UBE jurisdictions (including NY, TX, IL, DC, etc.). Frequency is based on the last 20 administrations (10 years).
| Subject | Testing Frequency | Common Sub-Topics |
|---|---|---|
| Civil Procedure | High (Almost every exam) | Personal Jurisdiction, Venue, Erie Doctrine. |
| Secured Transactions | Medium-High | Attachment, Perfection, Priority. |
| Wills & Estates | Medium | Validity, Revocation, Intestacy. |
| Agency & Partnership | Medium | Apparent Authority, Fiduciary Duties. |
| Family Law | Medium | Divorce Jurisdiction, Child Support/Custody. |
2. Non-UBE Major States Comparison
States like California, Florida, and Nevada test unique state-specific laws that do not appear on the MEE.
| Jurisdiction | Unique Essay Subjects | Standard Essay Format |
|---|---|---|
| California | Community Property, Professional Responsibility (CA-specific), CA Evidence. | 5 Essays (60 mins each) + 1 PT. |
| Florida | Florida Constitutional Law, FL Civil/Crim Procedure, Trusts. | 3 Essays (60 mins each). |
| Nevada | Community Property, NV Civil Procedure, Nevada Legal Ethics. | 6-8 Essays (some are 1-hour). |
3. Subject Frequency (MBE Subjects on Essays)
Even though they are tested on the multiple-choice portion, these subjects frequently cross over into essays:
- Constitutional Law: Often focused on First Amendment or Equal Protection.
- Contracts: High focus on UCC Article 2 vs. Common Law.
- Evidence: Typically tested as a "transcript" style question in CA or MEE.
- Real Property: Frequent focus on Landlord-Tenant or Easements.
Note: This matrix is updated twice yearly following the release of official subject matter outlines by the NCBE and state bar examiners.
