The headline departures from the national defaults are the powerful entire-controversy doctrine (claim preclusion), the affidavit-of-merit requirement, modified 51% comparative negligence with a 60% joint-liability threshold, very long adverse-possession periods, judicial-only foreclosure, a surviving Charitable Immunity Act, and a UPC-style estate regime with a conventional one-third elective share and no unusual elective-share quirks.

1. EXAM FORMAT

UBE state · MBE/MEE/MPT weighted 50/30/20 · minimum passing score 266 · score transferable to/from other UBE jurisdictions within the window · plus MPRE and character/fitness · post-admission practical-training requirement (Bridge-the-Gap/ICLE) · because it is UBE, essays are graded on national majority law—do not write NJ-specific rules unless a question localizes.

2. CIVIL PROCEDURE

ENTIRE-CONTROVERSY DOCTRINE (R. 4:30A)—a broad preclusion rule: assert ALL claims arising from one transaction/controversy in a single action or lose them; reaches further than ordinary res judicata (mandatory party-joinder branch narrowed, claim-joinder branch robust, equitably applied) · Affidavit of Merit (N.J.S.A. 2A:53A-26) required in professional-malpractice cases—miss it and the case is dismissed · tort SOL two years (2A:14-2), contracts six years (2A:14-1), defamation 1 yr · discovery rule + substantial compliance · Superior Court (Law/Chancery) general jurisdiction · commences by filing.

3. EVIDENCE

Own New Jersey Rules of Evidence, FRE-parallel · expert reliability largely Daubert-aligned in civil cases (In re Accutane) while keeping its own framework · usual privileges (attorney-client, spousal, clergy, physician-patient/psychologist) · state rules in state court, FRE in federal.

4. FAMILY LAW

No-fault (irreconcilable differences ≥6 months, or 18-month separation) plus fault grounds · equitable distribution (not community property), statutory factors (2A:34-23.1); gifts/inheritance to one spouse generally exempt · 2014 alimony reform—"open durational" alimony replaced permanent alimony; cohabitation/retirement modification triggers · palimony now requires a signed writing made with independent legal advice (2010 statute) · income-based child support.

5. WILLS / TRUSTS / ESTATES

7. TORTS

Modified comparative negligence — 51% bar (2A:15-5.1): recover only if fault NOT GREATER than defendants' combined—50% recovers, 51% barred · joint-and-several liability only for a defendant ≥60% at fault; below 60% = several share only (2A:15-5.3) · statutory dram-shop liability (Server Fair Liability Act, 2A:22A) + social-host liability for serving minors · distinctive Charitable Immunity Act (2A:53A-7)—limits beneficiary suits against nonprofits · punitive-damages cap: greater of 5× compensatory or $350k (2A:15-5.14), clear-and-convincing proof · public-entity claims under the Tort Claims Act (pain-and-suffering needs permanent injury + threshold).

8. CONTRACTS / UCC

9. BUSINESS ENTITIES

Corporations under the New Jersey Business Corporation Act (Title 14A)—substantially MBCA · LLCs under RULLCA (42:2C, adopted 2014) · partnerships under RUPA (42:1A) · confirm whether an LLC's operating agreement predates the 2014 RULLCA shift in default rules.
